Game Mode — SMS Terms

These SMS Terms apply to text messages sent and received through Game Mode, operated by Adalou LLC d/b/a Game Mode. They are part of the Organization Terms of Service for organizations, and part of the End User Terms for individuals.
For parents, guardians, and other recipients
Who is texting you. Text messages come from the youth sports organization you registered with. Game Mode provides the software the organization uses to send them. The organization decides what to send.
What you consented to. When you affirmatively opt in to text messages and provide your phone number, you consent to receive text messages from the organization identified in the opt-in disclosure, regarding the types of communications described there — typically tryouts, team activities, schedule changes, registrations, payments, and related program communications.
Providing a phone number by itself, completing a registration, or accepting these Terms does not on its own sign you up for text messages. You opt in through a separate box that is not pre-checked, and opting in is never required to register.
Message frequency. Message frequency varies and depends on your organization's activity — typically a few messages per month, and more during tryouts, registration periods, or schedule changes.
Cost. Message and data rates may apply. Game Mode does not charge you for text messages.
Stopping messages. Reply STOP to any message to stop receiving texts from that organization. You will receive one confirmation that no further messages will be sent. You can also ask your organization to remove your number.
Help. Reply HELP for help, or email support@gamemodeapp.com.
Delivery. Mobile carriers are not liable for delayed or undelivered messages.
Your information. Mobile information and text-message opt-in consent will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. How your information is handled is described in our Privacy Policy.
Stopping texts stops all of them. Replying STOP stops every text message from that organization, including reminders about registrations, schedules, and payments. Your organization may still contact you by email, and opting out of texts does not affect your access to the Service.
For organizations
You are the sender. Messages sent from your account are your messages. You are responsible for their content and for compliance with law and carrier rules, including the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and CTIA guidelines.
Consent is yours to obtain and record. Before texting anyone, you must have their affirmative consent to receive messages at that number, collected in a way that complies with law and carrier rules. Consent must be given through a separate affirmative opt-in, such as a checkbox that is not pre-checked, and must not be a condition of registration, purchase, or acceptance of terms. The opt-in must name your organization, describe the messages, and state that message frequency varies, that message and data rates may apply, and that STOP opts out and HELP gets help. Keep records of how and when consent was obtained. Do not text numbers obtained from purchased lists, third-party sources, or public directories.
Transactional and marketing consent are separate. Consent to receive messages about registrations, schedules, teams, and payments does not permit promotional or marketing messages. Marketing consent requires its own separate opt-in. A person may choose to receive transactional messages without agreeing to marketing messages. Replying STOP stops all text messages from that organization.
Opt-outs must be honored. STOP requests are processed automatically and recorded. You must also honor opt-out requests received any other way, and you must not re-add a number that opted out unless that person gives consent again.
Carrier registration. Text messaging requires a phone number registered with U.S. carriers to your organization under industry rules (A2P 10DLC). Registration is submitted on your behalf using information you provide, which must be accurate and complete. Carriers, not Game Mode, decide whether to approve a registration. Approval can take days or weeks. Carriers may reject, restrict, throttle, suspend, or block messages at any time. Texting is unavailable until registration is approved.
Public terms and privacy pages. Carrier registration requires publicly available terms and privacy pages describing your messaging practices and consent collection. Game Mode's pages cover the platform; you are responsible for your organization's own disclosures where your registration requires them.
Prohibited content. You may not send messages that are unlawful, deceptive, harassing, or that relate to categories carriers prohibit, including cannabis, illegal substances, firearms or firearm parts, gambling, high-risk financial offers, loan or debt services, or adult content.
Suspension. We may suspend or limit messaging, immediately and without notice, if we or a carrier believe messages from your organization violate law, carrier rules, or these SMS Terms, or generate complaints. We may also suspend messaging where required by a carrier or regulator.
Volumes and costs. Messaging volumes included with your plan are described in your plan's terms. Sustained use beyond ordinary club communication may require a higher plan or additional fees, with notice.
Your indemnity. As set out in the Organization Terms of Service, you indemnify Game Mode against claims arising from messages sent from your organization, including claims about consent, content, and opt-out compliance.
