Game Mode — End User Terms

These End User Terms ("Terms") apply to individuals who use Game Mode: parents and guardians, coaches, staff, volunteers, and other users ("you"). Game Mode is operated by Adalou LLC, a Wyoming limited liability company doing business as Game Mode ("Game Mode," "we," "us").

Your sports organization has its own agreement with us, the Organization Terms of Service. These End User Terms cover your personal use of Game Mode. Our Privacy Policy explains how information is handled.

By using Game Mode, you agree to these Terms.


1. Game Mode is software, not your sports organization

Game Mode provides software to your organization. We do not run programs, teams, tryouts, or facilities, and we do not make decisions about playing time, team placement, eligibility, refunds, or conduct.

Your agreement about the program itself is with your organization. Fees, refund policies, schedules, rosters, coaching, and everything else about the sport are theirs, not ours. Contact your organization first with questions about any of it.

2. Your account

You must be 18 or older to create an account. Accounts are for adults: parents, guardians, and organization staff. Children do not get their own accounts.

Keep your password secure. You are responsible for activity under your account. Tell us or your organization promptly if you believe your account has been compromised.

Information you provide must be accurate, and you must have the right to provide it, including information about your child.

3. Payments

Payments you make through Game Mode go to your organization's own payment account. Your organization is the merchant, sets its own prices, and sets its own refund policy. Card details are handled by Stripe; we do not store your card number.

Request refunds from your organization, not from Game Mode. If a payment appears wrong, contact your organization first.

4. Messages

Your organization may contact you by email and text message through Game Mode about tryouts, teams, schedules, registrations, and payments.

When you affirmatively opt in to text messages and provide your phone number, you consent to receive text messages from the organization identified in the opt-in disclosure, regarding the types of communications described there. Message and data rates may apply. Message frequency varies. Reply STOP to opt out. Reply HELP for assistance. Mobile carriers are not liable for delayed or undelivered messages.

Providing your phone number, registering, or accepting these Terms does not on its own sign you up for text messages. Replying STOP stops all text messages from that organization. Your organization may still contact you by email regarding registrations, payments, schedules, and other program communications.

Full details are in the SMS Terms. Mobile information and text-message opt-in consent will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.

5. Acceptable use

You will not:

  • use Game Mode in violation of any law or anyone else's rights;
  • upload content that is unlawful, harassing, abusive, or harmful to a child;
  • attempt to access information belonging to another family, team, or organization;
  • probe, scan, or test the security of the Service, or interfere with its operation;
  • copy, reverse engineer, or attempt to derive the source code of the Service;
  • use automated means to extract data, other than features we provide;
  • misrepresent who you are or who you are authorized to act for.

We may suspend access that breaks these rules or that threatens the safety or security of others.

6. Content you provide

You keep your rights in the information and files you submit. You grant Game Mode permission to host, store, transmit, and display that information as needed to run the Service for your organization, as described in our Privacy Policy.

Your organization controls the information in its account, including information about your child. Requests to review, correct, or delete it go to your organization, and we will help them respond.

7. Our intellectual property

Game Mode owns the Service, its software, design, and content. You may use it for your own personal, non-commercial purposes in connection with your organization.

8. Disclaimers and limits

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND TO THE FULLEST EXTENT PERMITTED BY LAW. We do not promise the Service will be uninterrupted or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, GAME MODE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability to you for any claim relating to the Service will not exceed $100. Amounts you paid your organization are not amounts we owe you; your organization holds that money and sets its refund policy.

Some states do not allow certain limitations, so parts of this section may not apply to you.

9. Disputes

Federal Arbitration Act. The Federal Arbitration Act governs the interpretation and enforcement of this section.

Informal resolution first. Email support@gamemodeapp.com with a description of the dispute. The parties will work in good faith for 30 days before starting any formal proceeding.

Optional mediation. After that period, either party may request mediation with the American Arbitration Association. Mediation happens only if both parties agree, and is not required before arbitration.

Binding arbitration. Disputes not resolved will be settled by final and binding arbitration administered by the AAA under its Consumer Arbitration Rules, before a single arbitrator, with hearings conducted remotely by video where the arbitrator permits.

Jury trial waiver. EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY.

Class action waiver. DISPUTES MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or confidential information.

Governing law. These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. For any matter not subject to arbitration, the courts located in Sheridan County, Wyoming have exclusive jurisdiction. This choice of law does not deprive you of any protection that cannot be waived under the law of the state where you reside.

10. Changes

We may update these Terms. If a change is material, we will post notice in the Service or email you before it takes effect. Continuing to use Game Mode after that means you accept the updated Terms.
